Losing your job is stressful. No matter what happened or why, it can be difficult to adjust. Whether you think it may have been your fault or something entirely out of your control, you can often do something about it.

Wrongful Dismissal

In Ontario, it is implied that most employees employed indefinitely are entitled to notice before being dismissed from their employment. A wrongful dismissal is when an employee is dismissed without proper notice (or pay instead) and severance pay. Aside from limited circumstances, an employer must always give reasonable notice of termination or provide a payment instead. Your former employer may try to pressure you into accepting the termination package they offer, thinking you have no other option. However, you may be entitled to more. If you think you may have been wrongfully dismissed, contact an employment lawyer at Kleinman Law, who will fight to get you what you deserve.

Even if your employer alleges termination for "Cause" and denies part of all of your notice period, you may be able to fight it. You may be entitled to notice or a severance package.

reasonable notice

Every employee in Ontario is protected by the laws in the Employment Standards Act (ESA). The ESA provides a collection of the minimum possible rights. You are given the right to vacation time, a limit to how much you can work, severance pay, pay stubs, overtime, and many other things. An employee is always entitled to their ESA rights.

The ESA only provides your minimum entitlement if terminated. You may have the right to more than the notice or severance required by the statute. You may have an employment contract which provides for more. Or, you may be entitled to what the Courts have decided is reasonable in the circumstances, which is called reasonable notice. If you don't have an employment contract, or your contract is unlawful, you could be entitled to reasonable notice of termination or a termination package instead. A lawyer can help you determine if what your employer is offering is right.
